Distance selling
In the case of distance selling (transactions and payments via the Internet), the buyer and seller are in different places at the same time (opposite: on-the-spot transaction). The resulting uncertainty about the true identity and intentions of the respective counterpart facilitated abuse. This was remedied by the increased use of guaranteed payments, which arose due to technical developments and contractual assurances. The legislator has also issued individual regulations to address this issue.
Prerequisites
In the case of a distance selling transaction, an entrepreneur is obligated pursuant to § 312d BGB to provide the consumer with essential information. These are:

  • Identity and, in the case of advance payments, the address of the supplier,
  • .
  • essential characteristics of the goods or services,
  • .
  • price including all taxes and delivery charges,
  • details of payment of delivery or performance,
  • a right of withdrawal,
  • information about after-sales service and applicable warranty conditions;
  • .
  • the terms of termination in the case of indefinite contract duration or a contract duration of more than one year.

Right of withdrawal
According to. § 312g of the German Civil Code (BGB), consumers are generally entitled to a right of withdrawal in accordance with § 355 of the BGB. The consumer can revoke his declaration of intent within a period of two weeks without giving reasons and is then no longer bound by the contract. The period begins when the ordered goods have been delivered.
